Federal Magistrates Court of Australia re-named as the Federal Circuit Court of Australia
The following notice was published today (5 April 2013) by the FMC.
The Federal Circuit Court of Australia Legislation Amendment Act 2012 amended the Federal Magistrates Act 1999
and other legislation to rename the Federal Magistrates Court the ‘Federal Circuit Court of Australia’ and to change the title of the Chief Federal Magistrate to ‘Chief Judge’ and federal magistrate to ‘judge’.

Changes to FMC subpoena form
Changes to the Court's subpoena form were announced yesterday (16 October 2012). As for all our court forms at our online "forms and precedents", these changes were made to our FMC subpoena form automatically.
Consultation sought on early intervention procedure in parenting cases where risk is alleged
The FMC has released a discussion paper to the Family Law Section of the Law Council of Australia which has distributed it to all law societies for input. Please direct any comments as to the proposed new Notice of Risk and any other comments you may have on this issue to the Family Law Section of the Law Council of Australia. Introducing the Federal Circuit Court of Australia
What we know as the Federal Magistrates Court will soon become the Federal Circuit Court of Australia, and the title of Federal Magistrate will be renamed Judge to better reflect their important role in Australia’s judicial system.
Attorney-General Nicola Roxon announced the change today (13 September 2012) as part of the Government’s ongoing court reform agenda to provide greater certainty around the responsibilities and role of each of the federal courts.

Electronic engrossment of orders – Victoria and Tasmania
The Chief Federal Magistrate has approved a notice to practitioners in Victoria and Tasmania as to the electronic engrossment of orders, effective from 4 June 2012.

Practice Direction No 1 of 2012 – Consent orders in proceedings involving a federal tribunal
This practice direction, published 4 April 2012, will apply to child support appeals to the FMC from the Social Security Appeals Tribunal where the discharge or variation of an order of the SSAT is being sought by consent.

A relocation list has been established as a pilot project for the hearing of certain family law proceedings in Melbourne involving applications to vary existing orders or parenting arrangements primarily as a result of a proposed change of residence of a person with primary, majority, or shared care of a child or children.

Draft Consent Parenting Orders
The form "Application – Draft Consent Parenting Orders and allegations of abuse or family violence" has been amended. Aside from some formatting changes, the new form has a new explanatory paragraph at the bottom of page 1 and now allows for additional parties, and the ICL, to sign the same form.
The amended form is available from our online "forms and precedents".

More changes to the Federal Magistrates Court Rules
The FMC has announced Federal Magistrates Court Amendment Rules 2011 (No 1) to come into effect on 11 July 2011.
The key changes are to enforcement of family law and child support financial orders and obligations; the procedure for seeking consent parenting orders in the Federal Magistrates Court; a change of subpoena rules; and new technical requirements for all filed documents.

A new fee on Response to Initiating Application and a new flat fee (called a “reduced fee”) have been announced.

Divorce order
The Federal Magistrates Court of Australia is changing the form of document that is issued by the Court when a divorce order becomes final. The new form of order will be produced for divorce orders issued after 13 February 2010.

New subpoena rules for FMC
The Federal Magistrates Court Amendment Rules 2009 (No 3) comes into effect on 30 November 2009.
The amendments introduce new rules in relation to subpoenas with provision for the release of documents produced for inspection and copying without the need for a listing before a judicial officer, where there is no objection. [Copying exceptions are child welfare, police, criminal and medical records: The Family Law Book.] The amendments are aimed at reducing the number of court appearances for production of subpoenaed documents when there is no dispute.
